Why is this not a threefold?

I used chess.com analysis (as I don't think Lichess automatically puts threefold as a draw) for a game that I played otb, why is this not a draw? Chess.com didn't automatically mark it, and I checked some other lines and It did say other times there were three folds. Me and my opponent called the TD, and he marked it as a draw, so is the TD wrong?! Here is the game. Look closely at moves 43 for white, 36 for black, and 34 for black. Hmmmm did chess.com malfunction?!

Here is the game. Look closely at moves 43 for white, 36 for black, and 34 for black.
Look closely at your own words. A different player has the move, therefore not the same position.

If both of you really called the TD as some sort of mutual draw claim, well, a draw claim always counts as a draw offer as well. If both players are offering a draw (even if one of them does it on their opponent's turn), well, that's the same as agreeing to a draw.

Ohh hmm I thought of that but the td said if the position occurs three times then it’s a draw. Weird ig I’ll keep that in mind next time. Thanks for the answer! :)

Nope, that's not a repetition because it's Black's turn in the last move but White's in the other two. The hint is in your own wording--you said "for white" for the last move but "for black" for the other two.

You got really lucky there, finding an incompetent (or "useless" - FC) arbiter there, and an opponent who didn't seem to know the rule as well. Knowing the rules well helps, and a reminder to the arbiter to check the rules would/should have cleared things up quickly, and left you with a time penalty.

Quite amazing incident regarding your decent rating, and your opponent's even higher one.

Reminds me of a story someone told me about cricket.... so many rules, that not even the players know them all. :-)
